Synopsis

An arbitrator has a duty to conduct the arbitration in a fair, expeditious, and economical manner to achieve a final resolution of the dispute. To do this an arbitrator must have an effective case management system.

An effective case management system is essential for ensuring an efficient, cost-effective, impartial, and fair arbitration process. It helps to minimise delays, reduce costs, promote clarity and consistency, and ensure compliance with legal and procedural requirements.

Often arbitrators face a range of problems when dealing with case management conflicts. These can include:

  • Efficient use of time
  • Clarity and consistency
  • Cost-effectiveness
  • Impartiality and Fairness
  • Procedural Compliance
  • Cooperation from parties and counsel
  • Legal and procedural complexities
  • Ethical considerations
  • Communications Issues
  • Guerrilla tactics and due process paranoia

This is not an exhaustive list of case management conflicts that arbitrators may face.

This workshop is intended to help arbitrators deal with some of these conflicts in managing their arbitrations. It is particularly helpful for architects who are new to arbitrations and particularly for architects who aspire to be arbitrators to learn about good and effective case management.


Speaker

Mr Johnny Tan Cheng Hye, Independent Arbitrator
A founding partner of LT&T Architects where he practised for over 30 years, Johnny practises now as an independent arbitrator, adjudicator and mediator. He is a Past President of the Singapore Institute of Arbitrators (SIArb), having served two terms as President from 2007 to 2011.

Johnny is a member of the panel of arbitrators of Singapore International Arbitration Centre (SIAC), Singapore Institute of Arbitrators (SIArb), Asian International Arbitration Centre (AIAC formerly KLRCA), Hong Kong International Arbitration Centre (HKIAC), Dubai International Arbitration Centre (DIAC), South China International Economic and Trade Arbitration Commission/Shenzhen Court of International Arbitration (SCIA), London Court of International Arbitration (LCIA), Russian Arbitration Centre, Pacific International Arbitration Centre (PAIC), Indian Institute of Arbitrators and Mediators (IIAM) and Singapore Institute of Architects (SIA). He is also a member of the Advisory Council to the National Commercial Arbitration Centre, Cambodia.

He is also a SIMI Accredited Mediator and a Principal Mediator with the Singapore Mediation Centre (SMC), China Council for the Promotion of International Trade/China Chamber of International Commerce (CCPIT/CCOIC Mediation Centre), International Accredited Professional Mediator of the Mainland – HK Joint Mediation Centre, Japan International Mediation Centre, Kyoto, International Dispute Resolution & Risk Management Institute of HK and China, and Singapore Construction Mediation Centre.

An accredited adjudicator with the Singapore Mediation Centre (SMC), Johnny also sits on the Construction Adjudicator Accreditation Committee (CAAC). He is also a member of the Singapore Infrastructure Dispute-Management Protocol Advisory Panel.

Johnny has held various positions in the Singapore Institute of Architects (SIA) and served as its Vice-President from 1998 to 2000. He has been extensively involved in the drafting of the SIA Standard Conditions of Contract (5th to 9th Edition), including making it SOPA compliant.

Johnny has been appointed as arbitrator in both institutional and ad hoc arbitration cases in Singapore, Brunei and Dubai. He has also been appointed as adjudicator as well as review adjudicator in several adjudication applications.

In addition to an active practice in architecture and ADR, Johnny also sits on the Board of Governors of Singapore Polytechnic and chairs the School of Architecture and the Built Environment Advisory Committee and the Admin and Development Committee. He is Chairman of the SP International Board.

Besides being a frequent speaker on construction and dispute resolution at both local and international conferences and seminars, Johnny conducts specialised training in these areas for government agencies, professional associations and the private sector both in Singapore and overseas.
