Synopsis
In October 2018, Parliament passed the Building and Construction Industry Security of Payment (Amendment) Act to introduce a series of wide ranging and important changes. These amendments will be brought into effect shortly.
The amendments include key changes to timing of payment claims, the importance of payment responses, a new limitation period for service of payment claim. The amendments also address concerns of contractors and Employers in termination situations and claims or across for loss, expense or damages.
Apart from the key changes in the Security of Payment Act, the speaker will also examine important recent cases in Singapore which affect cross-contract set offs and in particular, the recent Court of Appeal decision in Far East Square Pte Ltd v Yau Lee Construction (Singapore) Pte Ltd (2019) which dealt with adjudication on claims which can no longer be mounted under the contract eg post-final claims.
The speaker will also suggest amendments to be made to existing contractual arrangements to ensure that they are in line with the amendments to the Act. This seminar is highly recommended for project personnel who are concerned with evaluation of payment claims and payment responses.

Mr Christopher Chuah
Christopher Chuah heads the Infrastructure, Construction & Engineering Practice and is a Partner in the International Arbitration, China and Myanmar Practices. In January 2018, Christopher was amongst the inaugural batch of select practitioners to be appointed Senior Accredited Specialist in Building and Construction Law by the Singapore Academy of Law with many years of experience in adjudication.
He was amongst the first batch of adjudicators to be accredited under the SOP Act and a member of the Construction Adjudication Accreditation Committee and co-editor of the Singapore Construction Adjudication Review.
Christopher has also acted as leading counsel in many landmark construction cases including the recent Court of Appeal decision in Far East Square Pte Ltd v Yau Lee Construction (Singapore) Pte Ltd.
He is also an adjunct Professor in Construction Law at the Law Faculty of the National University of Singapore.
