Synopsis
Arm yourself with the basic dos and don’ts to avoid liability as architects in the construction industry. Deepen your understanding on your responsibilities, obligations and powers as the Architect under the SIA Conditions of Contract and at law. At this seminar, the speakers will explore key local caselaw on the duties and liabilities of architects and provide insights and lessons to be learnt from past reported cases. The seminar will cover common factual scenarios such as contract administration, certification, design and supervision of works and highlight potential liabilities viz-a-vis employers, main contractors, end-users and/or third parties.
Speakers
Mr Tay Peng Cheng
Mr. Tay Peng Cheng is Head of WongPartnership’s Energy, Projects & Construction Practice. With a practice focussed on the energy and utility industries, construction and engineering projects, and infrastructure developments, he advises clients on all aspects of project development and represents them in dispute resolution proceedings, including in disputes arising out of large-scale energy and utilities projects, construction and engineering contracts, and supply and offtake agreements. With close to 30 years of experience in these areas, he is highly ranked in various leading legal publications, with clients highlighting his "sharp legal skills”, "strong technical ability", and for being “commercially minded, practical and timely”.
Peng Cheng is recommended as a Global Leader for Construction and National Leader (Southeast Asia – Construction) in Who’s Who Legal, is recognised as a Litigation Star by Benchmark Litigation Asia-Pacific and is the winner of the Lexology Client Choice Award 2022 for Construction in Singapore. Peng Cheng is an accredited adjudicator under the SOP Act, has been appointed to the Eighth Panel of Arbitrators of the BAC / BIAC and the AIAC’s Panel of Adjudicators, and is a Fellow of the Chartered Institute of Arbitrators and the Asian Institute of Alternative Dispute Resolution.
Ms Kua Lay Theng
Ms Kua Lay Theng is a Partner in the Infrastructure, Construction & Engineering Practice at WongPartnership. Her area of practice focuses on advising parties in the construction industry for the entire lifecycle of projects. This encompasses front-end/ transactional work such as drafting, reviewing, negotiating and advising on standard forms of building contracts including the SIA, REDAS, PSSCOC and FIDIC forms; project advisory work during the execution of the project and contentious work arising from the project in arbitration (both international and domestic), statutory adjudication, mediation and litigation. She was a former Deputy Registrar of the Singapore International Arbitration Centre (SIAC).
Lay Theng is a recommended lawyer in The Legal 500 - The Client's Guide to the Asia Pacific Legal 2021 for Construction. She is a Fellow of the Chartered Institute of Arbitrators (CIArb). Lay Theng is an Adjunct Lecturer at the Building and Construction Authority (BCA) Academy and has conducted training, workshops and legal sharing sessions for Land Transport Authority (LTA), Jurong Town Corp (JTC), Surbana Jurong Group and other clients.
Ms Zhang Wen
Ms Zhang Wen is an Associate in the Energy, Projects & Construction Practice at WongPartnership. Her main practice areas include front-end work comprising reviewing, drafting and advising on various construction contracts and project documents including contracts relating to infrastructure projects, and various Engineering, Procurement and Construction contracts in relation to renewable energy and property development. Zhang Wen’s practice also includes contentious work where she has advised for employers and contractors in relation to construction-related disputes and other commercial matters.
Prior to her legal practice, she was a process safety consultant for an international engineering company specialising in the oil and gas, chemical and refining facilities in Singapore and the Asia-Pacific region. She is a qualified chemical engineer and holds a Master’s degree in Environmental Management.
