Synopsis
The Building and Construction Industry Security of Payment Act (“SOP Act”) was introduced nearly 20 years ago in 2005. The SOP Act aims to improve cash-flow in the building and construction industry by giving construction service providers such as Architects the right to obtain timely progress payment for services rendered.
Even though the SOP Act has been around for many years, many construction industry players may still be unclear about the detailed workings of the SOP Act. Some industry players are uncertain about the critical issues or crucial timelines under the SOP Act, while others are uncertain about the evidence and documentation needed to support a claim or defend against a claim under the SOP Act.
At the same time, even though the SIA Conditions of Appointment is a set of reference standard conditions for the engagement of Architect’s services, many Architects may be uncertain of their full rights under these conditions.
This webinar aims to provide an overview of the Adjudication process under the SOP Act and highlight key provisions, issues and timelines under the SOP Act that participants should pay extra attention to. Further, this webinar seeks to provide participants with a general understanding of the workings of the SOP Act and the adjudication process in relation to claims for fees for services rendered under the SIA Conditions of Appointment.
This webinar further provides key insights into the documents and evidence required for an Adjudication in relation to claims for the fees for architectural services rendered. It further explores how participants can enhance their documentation practice into their day-to-day activities.
Speaker
Mr. Yong Boon On
Boon On has been practising in the area of dispute resolution and construction law since 2003. He is accredited by the Singapore Academy of Law as a Senior Specialist in Building and Construction Law.
Boon On is also an accredited Adjudicator with the Singapore Mediation Centre. He has been involved in many adjudication cases, as counsel and adjudicator. He has advised and represented a wide array of clients including government authorities, developers, contractors, major international corporations as well as individuals in a wide variety of disputes such as commercial disputes, cross-border contractual disputes, engineering and construction disputes. Boon On has also advised and represented a wide array of clients in the drafting and negotiation of various constructions and engineering contracts.
Some significant matters that Boon On has worked on include arbitration in relation to claims arising out of the collapse of tunnelling work, claims arising out of the construction of a large power plant project in Indonesia and claims arising out of a railway construction project and advise on contract documentation for a power plant project in Indonesia.
Boon On was also the lead counsel in various notable Court cases including the Court of Appeal case of Shimizu Corporation and Stargood Construction Pte Ltd [2020] SGCA 37.
Boon On graduated from the national University of Singapore in June 2002 with a Bachelor of Laws LLB (Honours). He was called to the Bar in May 2003.
In addition, Boon On holds a Bachelor of Engineering (Honours) from the National University of Singapore. He practised engineering for about 4 years before his admission to read law. His engineering background proves invaluable to many of his clients especially in dealing with complex technical issues in engineering and construction matters.
Boon On also holds a Master of Science in Applied Finance from the National University of Singapore.
