Synopsis

Architectural profession is at the crossroads. Architects are now serving more enlightened and diverse clients with high expectation and are working in a challenging environment not only in the construction industry but across other industries and sectors as well. Traditional modes of practice may no longer be relevant and adequate. Transformation and innovation in architectural practice are paramount and the way forward.

This conference will examine and discuss fundamental shift to practice landscape and legislation to ensure comprehensiveness, inclusiveness and to be in line with current practice and legislation so that architects remain relevant, progressive and are well equipped to meet current and emerging challenges.

Keynote Speaker Presentation: Architecture Practice in a Post Pandemic Era by Ar. Ashvinkumar, Group CEO ONG&ONG Pte Ltd

Presentation Topic 1: Record Of Consensus Of SIA Members On Service Procurement Topics Members by Ar. Darren Benger, Managing Director VivATA Pte Ltd

The Record Of Consensus is a record of consensus of the main positions of SIA Members taken in regard to topics related to the procurement of architectural services.

The Record Of Consensus should not be construed as a set of mandatory provisions with which SIA Members must comply, but SIA Members may use this document as a reference to common opinion amongst architects, and for explanation on the reasons behind the position taken in the default standard terms set out in the SIA ‘Conditions of Appointment and Architects’ Services and Mode of Payment’ and various SIA guidelines (eg for Design Competitions).

In early 2022, the Record Of Consensus was updated in line with developments in the industry. The updates indicate that the SIA members seek to promote healthy modes of practices within the construction industry.

Presentation Topic 2: Changes to the SIA Conditions of Appointment and Architect’s Services and Mode of Payment by Ms. Amanda Koh, Partner Eldan Law LLP

This talk will discuss the new SIA Conditions of Appointment and Architect’s Services and Mode of Payment 4th Edition. It will focus on the key changes from the previous edition and provide insight as to the considerations behind the changes. The implications arising from the new provisions will be also be elaborated upon.

The talk will also touch on practical tips for putting together the consultancy contract and will also cover matters to look out for when administrating the contract. Applicable latest court cases will be discussed, and the lessons that may be drawn from them.


Speakers

Ar. Ashvinkumar-Group CEO ONG&ONG Pte Ltd
Ashvinkumar graduated with Honours from NUS in 1988 and has been a BOA registered Architect since 1990. Ashvinkumar's passion is in Environmentally Sustainable Development (ESD) and this has been an influence in his work since his undergraduate days.

His projects over the past decades have incorporated many aspects of sustainability. He has extensive working experience with Foreign Design Consultants like UNStudio, Carlos Ott, Kenzo Tange, Paul Tange and Paul Ruldolph.

Ashvinkumar was the President of the Singapore Institute of Architects from 2009-2012. He was conferred a PBM award in 2015 for his distinguished contributions as both the Steering Committee and Executive Committee member in the Indian Heritage Centre.


Ar. Darren Benger-VivATA Pte Ltd
Darren received his Bachelor of Architecture degree with First Class Honours from the University of Adelaide, Australia in 1995, and registered with the Board of Architects, Singapore in 2001.

Since 1996 Darren has resided in Singapore, and he is currently the Managing Director of VivATA Pte Ltd, an architectural practice.

Darren's involvement in the Singapore Institute of Architects includes election to Council for the 2007/08 to 2021/22 terms, and he has actively participated in various SIA committees

This includes the Architectural Business (fka Architects Appointment and Services Procurement) Committee from 2007 to present, through which the Darren was instrumental in the development of various tools and references, such as the SIA's Fee Calculator and the SIA Members' Consensus.

Darren has been involved in the SIA WSH Committee from 2010, the Building Contracts Committee since 2007, and the ADR Committee since 2008.


Ms. Amanda Koh-Eldan Law LLP
Amanda Koh advises various stakeholders in the building and construction industry, including government authorities, developers, contractors, major international corporations and consultants on front-end advisory matters and contentious matters including commercial disputes and complex construction and infrastructure-related projects issues.

Amanda has represented clients in the High Court as well as in the Court of Appeal and was involved in reported seminal court decisions. She has also represented clients in extensive construction-related claims in arbitration has also assisted her clients in the drafting of construction and consultancy agreements. She also regularly acts for various building and construction industry stakeholders in mounting as well as resisting of adjudication claims.

Amanda was involved in the drafting of the SIA Conditions of Appointment and Architect’s Services and Mode of Payment 4th Edition. She has published in the Singapore Academy of Law Practitioner Journal and was one of the contributors for Law & Practice of Construction Contracts in Singapore (5th Edition, 2018).
